Terms of Service
Effective date: [DATE]
Please read carefully. These terms include a disclaimer that onwards is not medical advice, an “as is” disclaimer of warranties, and a limitation of our liability. By using onwards you agree to them.
1. Acceptance
These Terms of Service (“Terms”) are an agreement between you and [Legal Entity Name] (“onwards”, “we”, “us”). By creating an account or using the onwards app or website (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use onwards. By using the Service you represent that you are 18 or older and able to enter into a binding agreement.
3. The Service
onwards is a wellness companion that helps you follow a food-and-routine plan, log meals (including by photo, which is analysed by a third-party AI service), and see your progress. We may add, change or remove features at any time.
4. Your account
You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for activity under your account. Tell us promptly at support@onwards.click if you suspect unauthorised use.
5. Acceptable use
You agree not to misuse the Service, including: breaking the law; infringing others’ rights; uploading content you don’t have the right to share or that depicts another person without consent; attempting to reverse engineer, disrupt, overload or gain unauthorised access to the Service; or using it to build a competing product.
6. Your content
You keep ownership of the content you submit (such as meal photos and logs). You grant us a limited, worldwide, royalty-free licence to host, process and display that content solely to operate and improve the Service for you — including sending meal photos to our AI provider for analysis as described in the Privacy Policy. You are responsible for your content and confirm you have the right to submit it.
7. Not medical advice; no guaranteed results
onwards is not a medical device, healthcare provider, or substitute for professional medical advice, diagnosis or treatment. Nothing in the Service creates a doctor–patient relationship. Always seek the advice of a qualified health professional before changing your diet, exercise or health routine, especially if you have a medical condition, are pregnant or nursing, or have a history of disordered eating.
Health and weight outcomes depend on many factors. We do not promise or guarantee any particular result. You use the Service, and act on any information it provides, at your own risk and using your own judgement.
If your relationship with food, eating or your body feels overwhelming, please seek support — in the US, the National Alliance for Eating Disorders helpline is 1‑866‑662‑1235 (Mon–Fri); referrals at findedhelp.com.
8. Third-party services
The Service relies on third parties (including Apple, Google, Clerk and AWS). Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.
9. Payments & subscriptions
[If you offer paid plans: describe pricing, billing, auto-renewal and cancellation. App Store purchases are processed by Apple and governed by Apple’s terms; manage or cancel subscriptions in your App Store account. Remove this section if the app is free.]
10. Intellectual property
The Service, including its software, design, text and the onwards name and logo, is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use under these Terms.
11. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that any meal analysis or suggestion will be accurate. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, onwards and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or [USD 50 / amount]. Nothing in these Terms limits liability that cannot be limited by law (for example, certain consumer rights, or liability for death or personal injury caused by negligence or for fraud).
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service or your breach of these Terms.
14. Termination
You may stop using the Service and delete your account at any time from inside the app. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive (e.g. 6, 7, 10–13, 15) will survive termination.
15. Governing law & disputes
These Terms are governed by the laws of [Governing jurisdiction], without regard to conflict-of-laws rules. The courts of [Venue] will have jurisdiction, except where mandatory local consumer law gives you the right to bring proceedings in your home country. [If you intend to require arbitration and/or a class-action waiver for US users, add a clearly-labelled, conspicuous arbitration clause here — counsel should draft it; it is not enforceable everywhere.]
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new effective date and, for material changes, provide additional notice. Continued use after changes take effect means you accept them.
